Terms of Service

1. Acceptance of terms
These Terms of Service (“Terms”) govern your access to and use of SimpleDock (the “Service”), provided by SimpleDock (“SimpleDock,” “we,” or “us”). By creating an account or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to that organization.
2. The Service
SimpleDock provides software for scheduling dock appointments at warehouses, plants, distribution centers, and similar facilities. Features include configurable booking pages, appointment-type and door management, SMS and email notifications, and calendar integrations. We may change, add, or remove features over time.
3. Accounts
You must provide accurate information when you register, keep your password confidential, and promptly notify us at support@simpledock.ai if you suspect unauthorized use. You are responsible for activity under your account. You must be at least 18 years old to create an account.
4. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, fraudulent, or deceptive purposes.
- Send unsolicited messages, harass anyone, or send content that violates the rights of others.
- Attempt to access accounts, systems, or data you are not authorized to access; probe, scan, or test the vulnerability of the Service; or interfere with its operation.
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law.
- Resell, sublicense, or otherwise commercialize the Service without our written permission.
5. Communications and SMS consent
The Service sends transactional messages such as appointment confirmations, reminders, and reschedule notifications by SMS and email. By providing a phone number during booking or in your account settings, you consent to receive these messages from SimpleDock and from the facility that scheduled the appointment. Standard message and data rates may apply. You can reply STOP to unsubscribe from non-essential SMS; doing so may prevent you from receiving important appointment information.
6. Customer data and end-user data
As a SimpleDock customer, you decide what information to collect from carriers, drivers, and other end users through your booking page. You are responsible for that information, for posting any notices required by law, and for obtaining any consents needed. We process this information on your behalf as described in our Privacy Policy.
7. Fees
Some features of the Service may be offered free during a beta period. We may introduce paid plans in the future. If we do, we will give you reasonable notice before charges begin and you will be free to stop using paid features.
8. Termination
You may close your account at any time. We may suspend or terminate your access if you violate these Terms or if your use of the Service exposes us or others to risk or legal liability. On termination, your right to use the Service ends and we may delete your data after a reasonable period.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPLEDOCK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS.
11. Indemnification
You agree to defend, indemnify, and hold harmless SimpleDock and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your data, or your violation of these Terms.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. The exclusive venue for any dispute will be the state or federal courts located in California, and you consent to personal jurisdiction there.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, give you additional notice. Continued use of the Service after changes take effect means you accept the updated Terms.
